Welcome to TrophySmack! Thanks for applying to our Affiliate Program.

The following terms and conditions apply to individuals ("Affiliate", "you") who are accessing or using the Affiliate Program to refer customers to  TrophySmack ("us", "we") to purchase products or services from us.

By participating in the Program, the Affiliate agrees to use the Program in the manner specified in and is bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety you are not authorized to register as an Affiliate or participate in the Affiliate Program in any manner.

1. Approval or Rejection of the Application

We reserve the right to approve or reject ANY Affiliate Program Registration at our sole and absolute discretion. Our Affiliate Program is designed to reward individuals that use social media platforms and podcasts to actively promote TrophySmack products. Affiliates whose discount or coupon codes are found on websites that make them available to the general public may be removed from the program. 

2. Affiliate Links and Coupons

A unique Affiliate referral link is generated automatically for the applicant once the application is approved. If a customer clicks through your Affiliate referral link, then later clicks through using a different Affiliate's referral link, the last used Affiliate link receives the Affiliate commission.  

3. Commissions and Payments

As you send traffic to our website via your Affiliate referral link, you will receive commission for each unique purchase. Your progress for each referral will be reflected in real-time on your Affiliate dashboard.

Since we can't track your sales and traffic without you posting the full URL of your referral link, please be sure to always use your Affiliate referral link. Our social sharing shortcuts have your Affiliate referral link embedded in the posts.

Whenever a referral visits our site using your Affiliate referral link, we start (or restart) a 180-day countdown clock from that date. If that referral makes a purchase on their initial visit, or they visit our site again using your affiliate link during that 180-day time frame, their purchase is credited to you. If that same referral comes directly to our site without using your affiliate link during that 180-day time frame, because they are assigned to you for 180 days, we will still credit the sale to you.

However, if that same referral comes to our site after the 180-day countdown clock has expired without using your affiliate link, you do not get credit for their purchase. Also, if that referral visits our site using another Affiliate's referral link, they would be reassigned to that other Affiliate and that Affiliate would get credit for any purchase. Bottom line, you always want your referrals to use your Affiliate referral link and make a purchase within 180 days of their last visit!

As your referrals generate sales, you will accrue a commission of 15% of the sale. Accrued commissions are considered "earned" the last day of the month following the month of the sale. This is to allow time for any returns, refunds, etc. Total accrued "earned" commissions over $50 are paid to you the month following the month they are "earned" (less a small fee of approximately 3% paid to PayPal to manage the transaction). 

4. Marketing tool

We may share promotional media such as banners, logos or other promotional material with you through the Marketing tool tab. You can download the media or get the HTML embed code in order to share it.

5. Network

If the Network tab is activated, an Affiliate can invite others to become their downline Affiliate by sharing their network link. Any other Affiliate who clicks on that link and signs up will become a downline Affiliate. If any downline Affiliate's referrals make a purchase from TrophySmack, the upline affiliate will also get a network commission (usually 2%-5% of the sale).

6. Cookie

We use a cookie to track people who have clicked on your link, so they need to allow cookies on their device in order for us to track them.

If a person doesn't allow cookies, or clears their cookies, then we can't track them and can't pay Affiliate for their purchases.

"Cookie days" is on the Affiliate registration form. The tracking day will start from the time a customer clicks on the affiliate’s link or uses the Affiliate's coupon. Within the cookie time frame, every order made by this customer at TrophySmack will automatically result in commissions to the Affiliate (There’s no need for the customer to click on the affiliate link then).

7. Removal from Referral Program

If an Affiliate wishes to be removed from the affiliate program, they can do so by contacting: sales@trophysmack.com

This privacy policy describes how we may collect and use personal data and the rights granted to TrophySmack ("Merchant"), Affiliates, and Customers regarding their respective data.

By joining the Affiliate Program, you signify your approval of the terms set out in this Privacy Policy, and other terms and conditions. If you do not agree to this Privacy Policy, you should not use the affiliate marketing system.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our privacy practices or for other operational, legal, or regulatory reasons. By continuing to participate in our Affiliate Program after these changes are posted, you agree to the revised policy.

Personal Information Controller

Any personal information provided to or gathered by UpPromote under this Privacy Notice will be stored and controlled by UpPromote (the data controller).

Information Collected From Merchants

When a Merchant uses UpPromote, we are automatically able to access certain types of information from their Shopify accounts such as email, first name, last name, and shop information (e.g. shop domain, shop currency, shop address). We collect this information to provide Merchants with our Services; such as customer support and advertising and marketing activities.

Information Collected From Affiliates

When an Affiliate signs up to join a program, we collect some information to inform the Merchant such as email, personal information, payment details, social network information, etc. This information helps the Merchant evaluate an Affiliate, assist in the completion of process-specific activities within the app, and contact the Affiliate if needed.

Information Collected from Customers 

In order to track an Affiliate referral order, when customers visit the Merchant website and make a purchase, UpPromote will collect information about the order such as total order, order items, order ID, etc.

About Cookies

“Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier.

Cookies are created when a user's browser loads a particular website. The website sends information to the browser which then creates a text file. Every time the user goes back to the same website, the browser retrieves and sends this file to the website's server.

Because cookies allow you to take advantage of some of the Affiliate marketing system’s essential features, we recommend that you leave them turned on.

Information Sharing

Ensuring your privacy is important to us. We do not share your personal information with third parties except as described in this privacy policy. We may share your personal information with third-party service providers who we employ to process specific functions; examples include providing email marketing activity, analyzing data and other marketing support. Third-party service providers have access to personal information only as needed to perform their functions and they must process the personal information in accordance with this Privacy Policy.

We may also disclose your personal information to any third party with your prior consent.

Use of UpPromote by Children

UpPromote is not intended for children. If a qualified Affiliate is under the age of 13, they may use the affiliate marketing system only with the supervision of their parent or guardian.

Your Rights

UpPromote understands that you have rights over your personal information, and takes reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. If you are an Affiliate or Customer and wish to exercise these rights, please contact us at smackzone@trophysmack.com. We may require that you provide us with acceptable verification of your identity before providing access to such information.

UpPromote serves as a processor on behalf of the Merchant, and can only forward your request to them to allow them to respond.
